The terms and conditions governing your use of CX Agency's website, products, and services.

Please read these Terms of Service carefully before purchasing or using any CX Agency product or service. By placing an order or accessing our digital products, you confirm that you have read, understood, and agree to these terms.

1. About CX Agency

CX Agency is the trading name of CX Advisory Ltd, registered in England and Wales. We provide digital CX operating systems, frameworks, toolkits, and consultancy services to B2B SaaS businesses. Our products are sold and delivered exclusively online through cxagency.io.

2. Acceptance of terms

By accessing our website or purchasing our products or services, you agree to be bound by these Terms of Service, together with our Privacy Policy. If you do not agree to these terms, please do not purchase from or use our website.

These terms apply to individual buyers and business customers. Where you are buying on behalf of a business, you confirm that you have the authority to bind that business to these terms.

3. Digital products

CX Agency sells digital operating systems and resources including (but not limited to):

  • Churn Crusher OS™
  • AI in CX OS™
  • The Complete CX OS™
  • Guides, playbooks, and templates

All products are sold in GBP (£). Prices are displayed inclusive of any applicable VAT where stated. CX Agency reserves the right to update pricing at any time; changes will not affect orders already placed.

Product descriptions are provided in good faith and we make every reasonable effort to ensure accuracy. However, digital products are inherently subject to updates and we may revise content at our discretion.

4. Access and delivery

Upon successful payment, you will receive access to your purchased product(s) by email within a reasonable time, typically immediately or within one business day. If you do not receive access within 24 hours, please contact us at sales@cxagency.io.

You are responsible for ensuring the email address provided at checkout is correct and that your email can receive messages from us. CX Agency is not liable for non-delivery due to incorrect contact details or spam filtering.

Where a product includes access to Notion databases, Google Sheets, or other third-party tools, access is dependent on those platforms remaining available. CX Agency does not guarantee the continued availability of third-party platforms.

5. Licence and intellectual property

All CX Agency products, content, frameworks, templates, and materials are the intellectual property of CX Advisory Ltd and are protected by copyright and other applicable laws.

Upon purchase, you are granted a non-exclusive, non-transferable, personal licence to use the purchased product for your own internal business purposes. This licence permits you to:

  • Adapt and use the frameworks and templates within your own organisation
  • Share outputs and adapted materials internally with your team

This licence does not permit you to:

  • Resell, sublicense, or distribute our products or any substantial portion of them
  • Reproduce our products on other platforms or in other publications without permission
  • Share access credentials or downloadable files with third parties outside your organisation
  • Use our products to create competing products or services
  • Remove, obscure, or alter any copyright or proprietary notices

Breach of this licence may result in termination of your access and legal action. If you wish to use our content in any way not covered above, please contact sales@cxagency.io.

6. Refund policy

Because our products are digital and delivered immediately upon purchase, we generally do not offer refunds once access has been granted. We ask that you review product descriptions carefully before purchasing.

However, if you have a genuine issue with your purchase — for example, a significant technical problem preventing access, or the product materially differs from its description — please contact us within 14 days of purchase at sales@cxagency.io and we will work with you to resolve the issue fairly.

This policy does not affect your statutory rights under UK consumer protection law, including where applicable rights under the Consumer Contracts Regulations 2013.

7. Consulting services

Where you engage CX Agency for consulting or implementation services (such as the CX Diagnostic, CX OS Build, or AI Implementation), a separate Statement of Work (SOW) or engagement letter will govern the specific deliverables, timeline, payment terms, and any other material terms for that engagement. In the event of conflict between these Terms and a SOW, the SOW will take precedence.

Services are delivered as described in the relevant SOW. CX Agency reserves the right to use subcontractors or associates to fulfil service engagements without prior notice, provided we remain responsible for the quality of delivery.

8. Limitation of liability

To the fullest extent permitted by applicable law, CX Advisory Ltd's total liability to you in connection with any product or service shall not exceed the amount you paid for that product or service.

CX Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to lost profits, lost revenue, loss of data, or business interruption arising from your use of, or inability to use, our products or services.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

9. Disclaimer of warranties

Our products and services are provided in good faith and based on extensive professional experience. However, the frameworks, playbooks, and recommendations contained in our products are general in nature and may not be suitable for every business context.

CX Agency does not warrant that implementing our operating systems will achieve specific results, including specific churn reduction percentages, revenue outcomes, or ROI figures cited in our marketing materials (which are based on published industry research). Results will vary depending on your team, product, market, and execution.

Our website and products are provided "as is" without warranties of any kind, either express or implied, except to the extent required by applicable law.

10. Acceptable use

You agree not to use our website or products in any way that is unlawful, harmful, or infringes the rights of others. Specifically, you must not:

  • Use our website or products to transmit unsolicited communications (spam)
  • Attempt to gain unauthorised access to any part of our systems
  • Use our content or brand to misrepresent your own products or services
  • Engage in any conduct that brings CX Agency or CX Advisory Ltd into disrepute

11. Third-party tools and links

Our products may include templates or references for use with third-party tools such as Notion, Google Sheets, Salesforce, and others. CX Agency is not affiliated with, endorsed by, or responsible for these platforms. Your use of third-party tools is governed by their own terms of service and privacy policies.

Links to third-party websites on our site are provided for convenience only. We do not control and are not responsible for their content or practices.

12. Changes to terms

We may update these Terms of Service from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or products after changes are published constitutes acceptance of the updated terms. We will take reasonable steps to notify existing customers of material changes.

13. Governing law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these terms or your use of CX Agency products and services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
